Welcome to Cominly, operated by Shashitu Enterprises LLC. By using our app, you agree to these terms.

1. Account Responsibility

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account
• You must be at least 13 years old to use Cominly, or the minimum age required in your country, whichever is higher
• If you are under the age of majority where you live, or under an age at which your local law requires a parent's or guardian's consent (for example 18 in India, or up to 16 in parts of the European Union), you may use Cominly only with that consent

2. Community Guidelines

• Be respectful to other community members
• Do not post illegal, threatening, or harassing content
• Do not spam or post misleading information
• Do not impersonate other people
• Community admins are responsible for moderating their communities

3. Content Ownership

• You own the content you post
• By posting, you grant Cominly a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your content for the purpose of operating and improving the service, including on our website and in future versions of the app. You keep ownership of your content, and this license ends when your content is deleted, except for copies already shared with others or retained in backups.

4. Prohibited Content

The following is not allowed:

• Hate speech or discrimination
• Threats or incitement of violence
• Sexually explicit content
• Illegal activities or content
• Spam, scams, or fraud
• Content that violates others' privacy

5. Moderation & Enforcement

• We reserve the right to remove any content that violates these terms
• Community names and uploaded images may be automatically screened for policy compliance
• We may suspend or terminate accounts that violate our policies
• Community admins may remove members from their communities
• You can report content using the Report feature

6. Service Availability

• We strive to keep Cominly available but cannot guarantee 100% uptime
• We may modify or discontinue features at any time
• We are not liable for any loss resulting from service interruptions

7. Fees

Cominly is free to use today. We may begin charging for some or all of the service in the future. If we ever ask you to pay, we will tell you what it costs and what it covers before you are charged, and you will be able to decide whether to continue. Nothing in these terms obligates us to keep any part of the service free.

8. Advertising and Sponsored Content

Cominly is free to use, and the app may show sponsored content from local businesses. Sponsored content is always clearly labelled. We do not use your personal information to target advertising, and we do not share your information with advertisers.

9. Money Between Members

Some communities use Cominly to organize money among their own members — for example savings circles, mutual aid or dues groups, and marketplace listings. In all of these, Cominly only records what members tell it. We do not hold, transfer, process, or escrow funds, we are not a bank, payment processor, money transmitter, or financial institution, and we are not a party to any agreement between members.

Members pay each other directly, outside the app, using whatever method they arrange. Payment details you enter and any payment confirmation you upload are your own submissions; we do not verify them. We do not guarantee that any member will pay, that any payout will be made, or that any record in the app is accurate.

Disputes about money are between the members involved and, where relevant, the community's organizers. We are not responsible for resolving them and are not liable for any loss arising from them. Organizing money this way may carry legal or tax obligations where you live; that is your responsibility, not ours.

You may not use Cominly for anything unlawful, including fraud, money laundering, unlicensed lending, or any scheme whose returns depend on recruiting new participants.

Savings circles, rotating savings groups, and mutual-aid, burial, or welfare funds are regulated in some countries. Some require a group to register or hold a licence, or to stay within limits on how many people join or how much is collected; others restrict collecting money from the public. The people who organize a group are responsible for knowing and following the rules where they and their members live, and for any registration, reporting, or tax those rules require. Cominly does not check whether a group is permitted where it operates.

A mutual-aid, burial, or welfare fund on Cominly is an arrangement among its members. It is not insurance. Cominly does not underwrite, guarantee, or pay any claim, and whether a payout is made, and how much, is decided by the fund's members and organizers under their own rules.

Nothing on Cominly is an offer of a loan, a deposit account, an investment, or interest. We may limit, suspend, or remove money features in a community or a country where we believe they break the law or put members at risk.

10. Where You Can Use Cominly

Cominly is offered worldwide, but you may not use it if you are located in, or ordinarily resident in, a country or region subject to comprehensive United States sanctions or embargoes; if you are named on a United States government list of prohibited or restricted parties; or if you are owned or controlled by, or acting for, anyone who is. You are responsible for following the laws that apply to you where you use Cominly. We may limit or turn off features in particular countries where the law requires it.

11. Limitation of Liability

Cominly is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, Shashitu Enterprises LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the service, including content posted by other users. To the fullest extent permitted by law, the total liability of Shashitu Enterprises LLC for all claims relating to Cominly is limited to the greater of the amount you paid us in the 12 months before the claim (Cominly is currently free to use) or 100 US dollars.

Some countries do not allow these exclusions or limits, so some of them may not apply to you. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded or limited under the law that applies to you.

12. Indemnification

You agree to indemnify and hold harmless Shashitu Enterprises LLC, its owners and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the app, the content you post, or your violation of these terms, any law, or the rights of others.

13. Governing Law & Dispute Resolution

These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-law rules. Any dispute arising from these terms or your use of Cominly will be resolved by binding individual arbitration, except that either party may seek relief in small-claims court. You and Shashitu Enterprises LLC waive any right to a jury trial and agree not to bring or participate in any class or representative action. If any part of this section is held unenforceable, the remainder of these terms still applies.

If you use Cominly as a consumer and live outside the United States, you keep the protection of the mandatory consumer laws of the country where you live, and nothing in these terms takes those rights away. Where your local law does not allow the arbitration agreement, the jury or class-action waiver, or the choice of Virginia law to apply to you, those parts do not apply to you, and you may bring a claim in the courts where you live.

14. Changes to Terms

We may update these terms from time to time. When we do, we will update the "Last updated" date and the terms version. For minor changes, continued use of the app after the changes take effect constitutes your acceptance. For material changes — such as fees, how we use your data, or dispute resolution — we will ask you to review and accept the updated terms before you continue using Cominly. If you do not accept, you may stop using the app and delete your account.
